Terms of Service

Last updated: 30 August 2026

1. Acceptance of These Terms

These Terms of Service ("Terms") govern access to and use of Bookixa ("we", "us", "our", the "Service"). By creating an account, you agree to be bound by these Terms. If you do not agree, do not use the Service.

2. What Bookixa Is

Bookixa is a scheduling tool that lets a business ("you", the "Business") manage appointments and lets that Business's own customers ("Customers") book them online. Bookixa provides the software only. Bookixa is not a party to, and has no responsibility for, the appointments, services, or transactions booked between a Business and its Customers. Any dispute about a missed appointment, service quality, refund, or payment for the underlying service is solely between the Business and its Customer.

3. Eligibility and Accounts

  • You must be at least 18 years old and legally able to enter into a binding contract to use the Service.
  • You must provide accurate information when creating an account and keep it up to date.
  • You are responsible for maintaining the security of your account and password, and for all activity that occurs under your account.
  • You must notify us promptly of any unauthorised use of your account.

4. Subscription and Payment

  • Account creation is free. Full access to the booking panel requires an active paid subscription ("Pro"), currently priced at £10/month, billed monthly in advance.
  • Payment is processed by Stripe. We do not receive or store your card details.
  • You may cancel at any time. If you cancel, you retain access until the end of the billing period you have already paid for; no partial refunds are given for the unused portion of a billing period.
  • If a payment fails, access may be suspended until payment is successfully completed.
  • We may change subscription pricing with reasonable notice. Continued use after a price change takes effect constitutes acceptance of the new price.

5. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose, or to offer, advertise, or facilitate illegal goods or services;
  • Impersonate any person or business, or misrepresent your affiliation with any person or business;
  • Attempt to gain unauthorised access to the Service, other accounts, or our systems;
  • Interfere with, overload, or disrupt the Service or its infrastructure;
  • Reverse engineer, decompile, or attempt to extract the source code of the Service, except where permitted by law;
  • Use the Service to send spam, harassing communications, or unsolicited marketing to Customers who have not consented.

We may suspend or terminate accounts that breach this section, with or without notice, at our discretion.

6. Business Responsibilities

As a Business using Bookixa, you are solely responsible for:

  • The accuracy of your listed services, prices, availability, and working hours;
  • Honouring appointments booked through the Service;
  • Handling payment, refunds, and any complaints relating to the services you provide to your Customers;
  • Complying with all laws applicable to your business, including consumer protection, data protection, and tax obligations;
  • The content of any messages, notes, or information you enter into the Service.

7. Email and Notification Delivery

Bookixa sends booking confirmations, reminders, and cancellation notices via third-party email infrastructure. We do not guarantee that any email will be delivered, delivered on time, or avoid being filtered as spam by the recipient's email provider. Businesses and Customers should not rely solely on these emails for time-critical confirmation of an appointment and should independently verify booking details where accuracy is critical.

8. Service Availability

The Service is provided on an "as is" and "as available" basis. We do not guarantee uninterrupted, error-free, or secure access to the Service at all times. The Service depends on third-party infrastructure (including Firebase, Stripe, Resend, and Vercel); we are not responsible for outages, delays, or failures caused by these third parties. We may modify, suspend, or discontinue any part of the Service at any time.

9. Disclaimer of Warranties

To the fullest extent permitted by law, we disclaim all warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will meet your requirements or be free of defects.

10. Limitation of Liability

To the fullest extent permitted by law:

  • We will not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, revenue, data, business opportunity, or goodwill, arising from your use of or inability to use the Service.
  • Our total aggregate liability to you for any claim arising out of or relating to these Terms or the Service will not exceed the total subscription fees you paid to us in the 12 months preceding the event giving rise to the claim.
  • Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited, such as liability for death or personal injury caused by negligence, or fraud.

Limitation-of-liability clauses between businesses are subject to a "reasonableness" test under UK law (Unfair Contract Terms Act 1977).

11. Indemnification

You agree to indemnify and hold us harmless from any claims, damages, losses, liabilities, and expenses (including reasonable legal fees) arising from: your use of the Service; your breach of these Terms; your violation of any law; or any dispute between you and your Customers.

12. Data and Content

You retain ownership of the business and customer data you enter into the Service. You grant us a licence to host, store, and process that data solely for the purpose of providing the Service to you. See our Privacy Policy for how personal data is handled.

13. Intellectual Property

The Bookixa name, logo, and underlying software are our property. These Terms do not grant you any right to use our branding or intellectual property except as necessary to use the Service as intended.

14. Termination

You may stop using the Service and cancel your subscription at any time. We may suspend or terminate your account if you breach these Terms, fail to pay subscription fees, or if we reasonably believe your use of the Service poses a risk to us, other users, or third parties. On termination, your right to access the Service ends; we may retain or delete your data in accordance with our Privacy Policy and applicable law.

15. Changes to These Terms

We may update these Terms from time to time. We will post the revised version here with an updated "Last updated" date. Material changes will be communicated where required by law. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.

16. Governing Law

These Terms are governed by the laws of England and Wales. Any dispute arising from these Terms or the Service will be subject to the exclusive jurisdiction of the courts of England and Wales.

17. Force Majeure

We will not be liable for any failure or delay in performance caused by circumstances beyond our reasonable control, including but not limited to acts of God, internet or infrastructure outages, or failures of third-party service providers.

18. Severability and Entire Agreement

If any provision of these Terms is found unenforceable, the remaining provisions will continue in full force. These Terms, together with our Privacy Policy, constitute the entire agreement between you and us regarding the Service.
